These notices set out the reservation of rights, the procedure for notifications of claimed infringement, the Company's privacy posture, the terms of use of this website, the governing law, and the formal authority by which the Company is bound. Read with the Company's About and Contact pages, they constitute the public legal position of Highway Global Limited.

§ I Reservation of Rights

All rights are
expressly reserved.

All intellectual property rights, names, marks, creative works, digital properties, documentary materials, goodwill, and related intangible assets held, administered, or controlled by Highway Global Limited are reserved.

Nothing on this website grants any licence, sublicence, assignment, permission, right of use, right of reproduction, right of distribution, right of display, right of adaptation, or other intellectual property right. No such right is granted by implication, estoppel, acquiescence, or otherwise.

Rights are granted only by written instrument executed by an authorised officer of the Company.

§ II Notification of Claimed Infringement

Form and procedure for
takedown notification.

Persons asserting that material under the custody or control of Highway Global Limited infringes their intellectual property rights may submit a written notification to the Company at the address shown below.

Required elements of a valid notification
  1. (a)Identification of the protected work claimed to have been infringed.
  2. (b)Identification of the allegedly infringing material in sufficient detail to enable the Company to locate it.
  3. (c)The name, postal address, telephone number, and electronic mail address of the claimant.
  4. (d)A statement that the claimant has a good-faith belief that the use of the material is not authorised by the rightsholder, its agent, or applicable law.
  5. (e)A statement that the information in the notification is accurate and, under penalty of perjury, that the claimant is authorised to act on behalf of the rightsholder.
  6. (f)The physical or electronic signature of the claimant.

Notifications that do not include the foregoing information may not be acted upon. The Company may, in its discretion, request further information before taking action.

Upon receipt of a compliant notification, the Company will review the matter and respond in due course through an authorised officer. The Company makes no representation as to any specific response time and reserves the right to take such action as it considers appropriate in the circumstances.

Counter-notification

A person whose material is the subject of a notification may submit a counter-notification in writing, identifying the material at issue, providing the information required of an original notification, and including a statement that the counter-claimant has a good-faith belief that the material was misidentified or that the use is otherwise authorised.

Repeat infringers

The Company reserves the right to refuse correspondence from, and to take such other action as it deems appropriate in respect of, persons who, in the reasonable judgment of the Company, are repeat infringers of intellectual property rights.

§ III Privacy & Correspondence

Processing of correspondence
and personal data.

Highway Global Limited processes personal data only to the extent necessary for the administration of intellectual property rights and the receipt of formal correspondence. The Company is not a public-facing platform and does not collect personal data from visitors save through correspondence sent voluntarily to the Company.

Information processed

The Company may process the names, contact details, professional affiliations, and the contents of correspondence sent to it, together with metadata associated with such correspondence.

Purposes

Information is processed for the administration of intellectual property rights; the receipt and handling of formal notices, takedown requests, and rights-management correspondence; the enforcement of the Company's rights and the protection of its interests; and compliance with applicable law.

Lawful basis

Where Regulation (EU) 2016/679 (the General Data Protection Regulation) or analogous law applies, the lawful basis for processing is the legitimate interest of the Company in the administration and protection of intellectual property rights and related intangible assets. Where consent is the appropriate basis, processing is undertaken only with consent.

Disclosure

Information may be disclosed to the Company's directors, officers, agents, professional advisers, registrars, and service providers, and to courts, regulators, and competent authorities where required by applicable law or contract.

Retention

Information is retained for the period necessary to fulfil the purposes set out above and as required by applicable law. Records relating to the administration of intellectual property rights may be retained indefinitely.

Data subject rights

Where applicable law confers rights upon the data subject, including rights of access, rectification, erasure, restriction, portability, and objection, enquiries may be addressed in writing to the address shown in § II above.

Confidentiality

Correspondence is treated as confidential business information unless otherwise required by applicable law or contract.

§ V Governing Law & Forum

Marshall Islands law and
reservation of remedies.

Highway Global Limited is incorporated and governed under the laws of the Republic of the Marshall Islands. Matters concerning the Company, its corporate affairs, and the internal administration of its assets are governed by Marshall Islands law and are subject to the jurisdiction of the courts of the Marshall Islands.

The foregoing does not limit the right of the Company to enforce its intellectual property rights in any jurisdiction in which those rights exist or in which infringement is alleged to occur. The Company reserves all rights and remedies available under applicable law and at equity.

Severability

If any provision of these notices is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to render it valid, legal, and enforceable while preserving its original intent.

§ VI Authority & Binding Instruments

The Company acts only by
written instrument.

Highway Global Limited acts only through written instruments executed by an authorised officer of the Company. No oral statement, telephone communication, informal exchange, automated response, or representation by any person, and no content on this website, shall constitute an undertaking, agreement, waiver, consent, or instrument binding upon the Company.

Without limitation of the foregoing, no licence, sublicence, assignment, permission, settlement, release, covenant not to sue, or other disposition of intellectual property rights is or shall be inferred from any communication other than a written instrument so executed.

The Company reserves the right to amend, supplement, withdraw, or replace these notices at any time and without prior notice. The version of these notices published on the website at the time of access shall apply.
